Alimony

Alimony is an award for the payment of support and maintenance of a spouse or former spouse, periodically or in a lump sum, for a specified period or for an indefinite term, ordered in an action for divorce, whether absolute or from bed and board, or in an action for alimony without divorce. In addition to establishing the existence of a dependent/supporting spouse relationship, the court will also consider many other factors such as the spouses’ relative earnings and capacity to earn, education level of the dependent spouse, contributions as a homemaker, sources and amounts of income, as well as any marital misconduct. Such marital fault may impact the amount, manner, and duration of the alimony award.
